A Florida man charged with manslaughter in the 2007 deaths of an Atmore couple was not supposed to be driving when he was involved in an accident in late March near Flomaton, according to court officials in Baldwin County.
George Wesley Hauer, 60, of Navarre, was charged a year ago with the deaths of Dwight Eugene Nichols, 74, and his wife Wilma Ellavan Nichols, 77, when their vehicles collided head-on. Hauer had been driving north on U.S. 31 and the Nicholses were traveling south near Bay Minette.
Hauer was charged in a grand jury indictment in February 2008 with operating a motor vehicle recklessly, causing the death of another person.
Hauer was involved in an accident March 22 on U.S. 31 at Old Fannie Road when his car collided with one driven by David Smith of Flomaton, who was traveling with his wife and two children. Hauer, Smith, his wife, Leigh Smith and daughter, Samantha Bryant were all injured.
Now prosecutors have filed a motion to have Hauer’s bond in the manslaughter case revoked. He was released after his arrest last year on $100,000 bond, but one of the conditions, according to court records, was that he not drive or be in physical control of a motor vehicle.
